개정안에는 민간택지에 지어진 공공임대주택의 조기분양 시 2곳 이상의 감정평가법인으로부터 감정평가를 받아 이를 평균하여 분양가를 산정하도록 의무화하는 공공주택특별법 개정안이 포함됐다. 

이번 개정안은 건설임대업자가 독단적으로 분양가를 결정하는 횡포를 막고 객관적이고 투명한 방식으로 분양가가 결정될 수 있도록 입법화하여 힘없는 서민들의 권익을 지켜주기 위해 마련되었다.

현행 공공주택특별법에서는 공공임대주택 만기분양의 경우 지자체장이 선정한 2곳 이상의 감정평가법인으로부터 감정평가를 받아 평균하여 분양가를 결정하도록 하고 있으나, 민간택지에 지어진 85제곱미터 이하 공공임대주택을 조기분양하는 경우에 대해서는 감정평가액 산출방식을 규정하고 있지 않아 입법의 흠결이라는 지적이 있었다.

이러한 입법의 흠결을 틈타 조기분양시 임대주택 건설업체가 일방적으로 선정한 감정평가법인이 책정한 분양가를 입주민들에게 불시에 통보하는 건설업체의 횡포가 전국 곳곳에서 발생하고 있어 입주민들의 불만이 팽배한 상황이었다.

일례로, 임대주택 건설업체인 부영주택은 작년 8월 경북 영주시 소재의 ‘가흥부영사랑으로’아파트의 세대별 우편함을 통해 일방적으로 산정한 조기 분양가액을 기습 통보한 바 있다.

부영주택이 선정한 1곳의 감정평가업체를 통해 산출된 분양가는 이후 입주민들이 자체적으로 의뢰한 감정평가액에 비해 턱없이 높게 책정된 것이었고, 사전에 조기분양 실시에 대해 주민과의 협의나 안내 등의 절차도 없었다.

비록 민간건설회사에 의해 민간택지에 지어진 아파트지만 주택도시기금의 지원을 받아 건설되었기에 최소한의 공공성은 유지되어야 함에도, 부영주택은 기업의 이익만 극대화하려 할 뿐 주민의 건의와 요구사항은 철저히 외면했다.

박형수 의원은 이와 같은 횡포와 폐단을 해결하기 위해 조기분양 시에도 만기분양 시와 같이 지자체장이 두 곳 이상의 감정평가법인을 선정해 두 곳 법인 산정가의 평균값이 분양가가 될 수 있도록 하는 개정안을 발의한 것이다.

박 의원은 “그동안 수 차례 국토부와 협의하고 입주민들의 건의도 수렴하여 이번 개정안을 준비했다”면서, “빠른 시일 내에 개정안이 국회에서 통과되도록 하여 입법의 흠결을 보완하고 무주택 서민들이 불이익을 당하지 않도록 제도적으로 해결하겠다”고 말했다.
