【브레이크뉴스 대구】진예솔 기자=대법원이 정치자금법 위반 혐의로 재판에 넘겨진 윤석준 대구 동구청장에 대해 벌금 200만 원을 확정했다. 벌금 100만 원 이상의 형이 확정되면서 윤 구청장은 당선이 무효가 돼 구청장직을 잃게 됐다.

대법원 3부(주심 오경미 대법관)는 12일 윤 구청장의 정치자금법 위반 혐의에 대한 상고심에서 원심이 선고한 벌금 200만 원을 그대로 확정했다.

윤 구청장은 2022년 지방선거를 앞두고, 선거관리위원회에 신고하지 않은 계좌로 홍보 문자 발송 비용 등 약 2,665만 원을 주고받은 혐의로 재판에 넘겨졌다.

앞서 1심과 2심 재판부는 정치자금의 수입·지출은 반드시 선관위에 신고된 계좌를 통해 이뤄져야 한다는 정치자금법 규정 위반에 해당한다며, 벌금 200만 원을 선고했다. 항소심 재판부는 특히 신고하지 않은 계좌를 사용한 것은 선거비용 규제를 피하기 위한 의도가 있었다고 설명했다.

대법원도 이 같은 원심 판단이 옳다고 봤다. 재판부는 신고 계좌를 거치지 않은 선거비용 지출 역시 정치자금법 위반에 해당한다는 원심의 해석에 문제가 없다고 판단해, 최종적으로 윤 구청장의 상고를 기각했다.

공직선거법상 선거비용 위반으로 벌금 100만 원 이상의 형이 확정되면 당선이 무효가 된다. 이에 따라 윤 구청장은 판결이 확정되는 즉시 구청장직을 잃게 된다.

대구 동구청은 판결 확정 사실이 통보되면, 곧바로 직무대행 체제로 전환할 예정이다. 관할 선거관리위원회도 당선무효 공고 절차를 밟을 것으로 보인다.

한편, 국민의힘 대구시당은 윤 구청장에 대한 당 차원의 징계 여부 등을 논의할 계획이라고 밝혔다. 윤 구청장은 올해 6월 지방선거 공천 신청은 하지 않은 상태다.
