최근 더불어민주당은 헌법재판소 후임자가 임명되지 않은 재판관은 임기가 만료되거나 정년이 도래한 후에도 직무를 연속적으로 수행할 수 있도록 하는 내용의 헌법재판소법 개정안을 발의했다. 

민주당이 발의한 헌법재판소법 개정안은 문재인 전 대통령이 임명한 문형배·이미선 두 재판관의 임기가 4월 18일 만료되는 것을 염두에 둔 임기 연장이라는 비판과 함께 법이 정한 6년의 임기를 무시하고 임기를 연장하는 것은 위헌 소지가 다분하다는 지적이 제기된다.

김승수 의원은 임기가 만료되거나 정년이 도래한 헌법재판소 재판관은 후임자가 임명되지 않았을 때도 직무를 수행하지 않는 내용의 헌법재판소법 일부개정법률안을 대표 발의했다.

김 의원은 “헌법에서 법관의 임기를 정한 것은 법관의 독립성을 보장하기 위한 것인데 정략적으로 이용하려는 민주당의 오만함을 가만 두고 볼 수 없다”며 “개정안이 통과되면 특정 정당이 의도적으로 재판관 선출에 협조하지 않는 등의 부작용을 방지하고 정략적으로 이용되지 않도록 보다 명확한 법 해석이 가능해질 것으로 기대된다”고 말했다.

Rep. Kim said, “The Constitution stipulates the term of office of judges to guarantee the independence of judges, but we cannot sit idly by and watch the Democratic Party’s arrogance in trying to use it for political purposes.” He added, “If the amendment passes, it is expected to prevent adverse effects, such as a specific political party intentionally not cooperating in the election of judges, and make it possible to interpret the law more clearly so that it is not used for political purposes.”
