이에 반해 국가, 지자체 및 공공기관과 원사업자 간 계약에 적용하는 ‘국가계약법’ 및 ‘지방계약법’, 민간 발주자와 원사업자 간 계약에 적용하는 ‘건설산업기본법’ 등 유관 법안에서는 건설공사계약 시 부당한 특약이나 조건을 정하지 못하게 하고, 부당한 특약 등은 무효로 정하고 있는 상황이다.
개정안에서는 하도급거래 계약에서의 부당한 특약은 그에 해당하는 부분에 한정하여 무효로 한다는 내용의 조항을 신설했다.
김상훈 의원은 “법 개정을 통해 공정한 하도급거래 질서 정착 및 수급사업자의 신속한 권리구제를 도모하고자 했다”며 법안 발의 취지를 전했다.
아울러 그는 “부당특약을 무효화 하면, 원사업자가 애초에 문제 되는 특약을 설정할 유인이 줄어들기 때문에 법 위반행위를 예방하는 효과까지 있다”고 덧붙였다.

The revised bill newly established a provision that unfair special contracts in subcontracting contracts are invalid only for the corresponding portion.
Rep. Kim Sang-hoon said, “We wanted to establish a fair subcontracting order and seek swift redress for the rights of subcontractors through the revision of the law,” explaining the purpose of the bill. He also added, “If unfair special contracts are invalidated, the incentive for the original contractor to set problematic special contracts in the first place will be reduced, which will have the effect of preventing violations of the law.”
