경북여심위에 따르면 A씨는 대통령선거여론조사의 결과에 조사완료 사례수와 그 응답값을 허위로 중복 반영하여 그 결과를 왜곡 공표‧보도했고, 대선여론조사 및 경북도내 4개 시‧군의장선거여론조사의 관련 자료를 선거일 후 6개월까지 보관하지 않는 등 공직선거법 제96조제1항·제108조제6항을 위반한 혐의가 있는 것으로 알려진다.
또한, 선거여론조사기관은 소속직원 A씨의 위반행위를 방지하기 위해 교육과 업무처리에 대한 주의‧감독을 하지 않아 같은 법 제260조를 위반한 혐의가 있다.
경북여심위 관계자는 “유권자의 올바른 판단을 방해하는 선거여론조사 결과의 왜곡 공표‧보도 행위 등을 중대선거범죄로 규정하고 앞으로 유사사례가 발생하는 경우 위원회의 모든 조사 역량을 투입해 무관용의 원칙에 따라 고발 등 엄중 조치하겠다.”고 밝혔다.
