대구시가 자체 조례를 위반해 동상을 설치했다는 주장과 함께, 법령보다 전 시장 개인 의중이 우선된 행정 관행의 대표 사례라는 비판이 제기됐다.

대구경제정의실천시민연합(대구경실련)은 15일 “대구시가 ‘동상·기념비·조형물의 건립 등에 관한 조례’를 위반하고 동대구역 광장에 박정희 전 대통령 동상을 설치했다”며 “조례 위반에 대한 책임을 반드시 물을 것”이라고 밝혔다.

이들은 동상 건립 대상 인물 기준 위반을 지적했다. 조례에 따르면 공공시설 동상 설치 대상은 ‘역사적 자료나 고증을 통해 객관적 평가가 정립된 인물’로 한정되며, 국난 극복, 국권 수호, 시민 공감 등 공적 기여도가 기준이다. 그러나 대구경실련은 “박 전 대통령은 역사적 평가가 진행 중이고 시민 평가가 극단적으로 엇갈리는 인물로, 공공시설 동상 설치 대상이 아니다”라고 강조했다.

건립 위치와 제작 기준도 문제삼았다. 조례는 인물과의 관련성, 주변 환경과 조화, 작품성과 조형성 등을 고려하도록 하고 있으나, 동대구역 광장은 박 전 대통령과 직접적 관련이 없고, 동상이 주변 환경과도 어울리지 않는다는 것이다. 

시민단체는 특히 “홍준표 전 시장의 동상이라는 지적이 제기될 정도로 박 대통령과 닮지 않았다”며 “이 또한 조례 위반”이라고 주장했다.

또한 면적 기준 초과 의혹도 제기됐다. 조례상 공공시설 동상 건립 부지 면적은 16㎡ 이하이지만 현재 동상은 이를 크게 초과한 것으로 알려졌다. 

조례상 심의위원회를 통한 조정이 가능하지만, 민선 8기 행정에서는 심의위원회 절차가 제대로 이뤄지지 않았을 가능성이 높다고 시민단체는 지적했다.

이들은 조례 적용 대상 해석 문제에 대해서도 "‘박정희 대통령 기념사업 조례’에는 동상 건립 및 관리 규정이 없기 때문에 대구시는 ‘동상·기념비·조형물 건립 조례’를 적용해야 한다"고 꼬집었다.

대구경실련은 “동대구역 박정희 동상 설치는 전 시장의 의중을 법령과 규정보다 우선시한 행정 관행의 사례”라며 “유사 사례 재발 방지를 위해서라도 진상과 책임을 반드시 규명해야 한다”고 강조했다.

현재 국가철도공단이 대구시를 상대로 제기한 동상 철거 소송도 진행 중이어서 논란은 쉽게 가라앉지 않을 전망이다.

Controversy has flared again surrounding the statue of former President Park Chung-hee installed in the plaza of Dongdaegu Station.

The Daegu Citizens' Coalition for Economic Justice (CCJ) announced on the 15th, "Daegu City violated the 'Ordinance on the Erection of Statues, Monuments, and Sculptures' by installing a statue of former President Park Chung-hee in the plaza of Dongdaegu Station." They added, "We will hold them accountable for this violation."

They pointed out the violation of the criteria for statues. According to the ordinance, statues at public facilities are limited to "figures objectively evaluated through historical data or research," and are based on their public contributions, such as overcoming national crises, protecting national sovereignty, and empathizing with the public. However, the Daegu Citizens' Coalition for Economic Justice emphasized, "Former President Park is a figure whose historical evaluation is ongoing and whose public opinion is extremely divided, and therefore, she is not a candidate for the installation of a statue at a public facility."

The organization also raised questions about the location and construction standards for the statue. The ordinance stipulates considerations for the statue's relevance to the person, its harmony with the surrounding environment, and its artistic and aesthetic qualities. However, the Dongdaegu Station plaza has no direct connection to former President Park, and the statue does not fit in with the surrounding environment.

The civic group specifically argued, "It bears no resemblance to President Park, to the point that some have pointed out that it's a statue of former Mayor Hong Joon-pyo," and that "this is also a violation of the ordinance."

Also, suspicions were raised about the statue exceeding the area standards. The ordinance stipulates that the site for a public facility statue must be no more than 16 square meters, but the current statue reportedly significantly exceeds this limit.

While the ordinance allows for adjustments through the review committee, the civic group pointed out that the review committee process likely did not properly take place during the 8th elected administration.

They also criticized the interpretation of the ordinance's scope, stating, "Since the 'President Park Chung-hee Memorial Project Ordinance' does not include regulations on the erection and management of statues, Daegu City should apply the 'Statues, Monuments, and Sculptures Erection Ordinance.'"

Daegu Citizens' Coalition for Economic Justice emphasized, "The installation of the Park Chung-hee statue at Dongdaegu Station is an example of administrative practice that prioritized the former mayor's wishes over laws and regulations." They added, "To prevent similar incidents from recurring, the truth and accountability must be uncovered."

The controversy is expected to persist, as the Korea Railroad Corporation is currently suing Daegu City for the statue's removal.
