26일, 울산에서 열린 임시회에서 이만규 의장은 “국가가 법령으로 의무화한 도시철도 무임승차 손실은 원인자 부담원칙에 따라 국가가 부담해야 한다.”고 주장하며 건의안을 제출했다.

현재 '노인복지법, '장애인복지법' 등과 관련 시행령에 따라 노인과 장애인 등에 대한 도시철도 이용료는 100% 면제해야 하고 도시철도무임승차는 법령에 따른 국가사무이다.

지방재정법 제21조에 따라 국가사무를 지방자치단체가 수행할 경우 원인자 부담원칙에 따라 국가가 이에 따른 재정을 부담해야 하나 정부는 도시철도 무임승차에 따른 손실을 전적으로 지방정부에 전가하고 있고, 지방정부 손실보전을 위한 도시철도법 개정안도 정부의 반대로 아직 국회의 문턱을 넘지 못하고 있다.

이만규 의장은 “1984년 시행된 도시철도 법정무임승차는 장애인 등의 이동권을 보장하고 사회·경제·문화적 편익을 창출하는 데 크게 기여하고 있지만 이에 따른 누적 무임 손실만 지난 5년간 무려 2조 7천억이 넘는다.”고 설명하며 “연평균 5천 526억 원이 발생하는 무임 손실은 도시철도 경영난을 초래하고 지방자치단체 재정에도 심각한 부담을 주고 있어 국가차원의 대책이 필요하다.”고 주장했다.

그러면서 그는 “도시철도 무임승차로 인한 손실은 요금결정권도 없는 지방자치단체가 부담해야 할 비용이 아니다.”라며 “관련 법에 따라 해당 법령의 소관 부처인 보건복지부, 국가보훈처 등이 국비 분담분을 비례 배분해 국비를 지원해 줄 것”을 요구했다.

또한 국회에는 “정부의 무임승차에 따른 지방정부 손실지원 근거 마련을 위한「도시철도법」등 공익서비스 관련 입법안을 조속히 처리해 줄 것”을 강력히 촉구했다.

이날 이만규 의장이 제출한 건의안은 원안대로 협의회 의결에 통과되었으며, 이후 국토교통부, 보건복지부 등 소관부처와 국회에 대한민국시․도의회의장협의회 공식 건의문으로 제출될 예정이다.
