현행법에 따르면, 부동산임대사업을 하는 자가 상가건물에 대한 임대료를 인하하는 경우 해당 임대료 인하분의 100분의 70(기준소득금액이 1억원을 초과하는 경우에는 100분의 50)에 해당하는 금액을 소득세 또는 법인세에서 공제하여 주도록 하는 조세특례를 두고 있다.
특례가 2022년 12월 31일로 종료될 예정이었으나, 양 의원이 대표발의한 「조세특례제한법」이 국회 본회의를 통과함에 따라 2023년 12월 31일까지 일몰기한이 연장되었다.
양금희 의원은 “최근 코로나-19의 재확산 및 경기둔화의 우려 등으로 소상공인의 경영 여건이 더욱 악화되고 있어 소상공인분들의 임차료 부담이 여전히 큰 상황이 이어지고 있다.”며, “개정안의 본회의 통과가 지연되면서 국민분들의 우려가 이만저만이 아니었는데, 다행히 일몰 기한 끝나기 전에 통과되어 소상공인분들의 부담을 덜어드릴 수 있게 되었다.”고 밝혔다.
