【브레이크뉴스 대구 】이성현 기자=신천지 대구교회 간부들에 대한 형사재판 결과에 대해 대구시는 “재판 결과와 관계없이 민사 및 행정 소송은 차질 없이 준비하겠다”는 입장을 나타냈다
3일 대구지방법원은 감염병예방법위반(역학조사방해 혐의) 등으로 기소된 신천지예수교 증거장막성전 다대오지파(이하 ‘신천지 대구교회’라 한다) 간부 8명에 대해 무죄를 선고했다.
대구시는 지난 해 6월 18일. 신천지 대구교회 및 총회장을 상대로 1,000억원의 민사소송을 제기한 바 있다.이에 대해서는 이미 법원으로부터 신천지 대구교회 건물을 포함한 부동산, 예금 등에 대한 가압류결정을 받아놓고 있다.
대구시는 또, 신천지 대구교회 측이 교회 건물 등의 폐쇄조치에 대해 행정심판 및 행정소송을 제기하는 등 집행정지 신청을 한 상태다 이에 대해 법원은 기각 결정을 내린 바 있다.
대구시는 “이번 형사재판 결과는 역학조사의 범위에 관한 법리적 쟁점에 따른 것으로, 시가 제기한 민사소송이나 신천지 대구교회 측이 시를 상대로 제기한 행정소송의 결과에 직접적 영향을 미친다고 보기는 어렵다”며 “특히 민사소송의 경우 신천지 대구교회 간부들의 형사상 책임과는 별개로 ① 거짓 자료의 제출 등에 따른 방역방해로 손해배상을 청구하고 ② 지역사회 감염 전파ㆍ확산에 의한 각종 비용 지출과 관련해서 그 원인제공자에 대한 구상권을 행사하는 것이므로 그 성격이 다르다”고 강조했다.
대구시는 형사재판 진행과정을 계속 예의주시하면서 민사ㆍ행정소송 대응에도 만전을 기할 예정이며, 역학조사방해 혐의와 관련해서는 재판 진행 과정에서 피고인들과 검찰 사이에 치열한 법리 다툼이 있었던만큼, 검찰이 이 부분에 대해서는 항소할 것으로 알려지고 있다.
