【브레이크뉴스 대구】진예솔 기자=더불어민주당 서미화 의원(보건복지위원회)이 30일 국정감사에서 HIV 감염인을 '면역기능 손상에 따른 장애'로 인정해야 한다고 주장했다. 

그동안 제도권 밖에 있던 감염인들의 현실에 국가가 응답하기 시작했다는 점에서 인권단체들은 긍정적으로 평가했다.

서 의원은 “HIV 감염은 단순한 질병이 아니라 면역 기능 저하와 사회적 차별이 동시에 나타나는 복합적 장애”라며 “법과 제도에 감염인을 포함해야 한다”고 강조했다.

이에 대해 ‘HIV 장애인정 전국연대’는 “이번 질의는 복지 확장을 넘어 인간의 존엄성과 생명권을 묻는 의미 있는 행동”이라고 의미를 부여했다.

현재 '장애인복지법 시행령'에는 HIV 감염이 장애 유형으로 포함돼 있지 않다. 이 때문에 감염인들은 고용이나 이동, 돌봄 등에서 기본적인 지원을 제대로 받지 못하고 있다. 

그러나 한국보건사회연구원은 과거 연구에서 HIV 감염을 '면역기관의 장애'이자 '사회적 장애'로 규정한 바 있고, 2022년 유엔 장애인권리위원회 역시 한국 정부에 HIV 감염인을 장애 범주에 포함하라고 권고했다.

연대 측은 “목록에 없다는 이유로 제도 밖에 남겨진 감염인들의 삶이 멈춰 있다”며 “국가는 더 이상 법의 형식 뒤에 숨지 말아야 한다”고 지적했다. 

실제로 대구지방법원에서는 'HIV 장애등록 반려처분 취소소송'이 진행 중이며, 제도적 모순을 보여주는 대표적인 사례로 주목받고 있다.

연대는 이번 질의를 계기로 △면역 기능 손상에 대한 장애 인정 기준 마련 △'장애인복지법 시행령' 개정 착수 △복지 사각지대 해소를 위한 입법 추진 등이 필요하다고 정부에 요구했다.

연대는 “법이 늦으면 사람이 사라진다. 이제는 국가가 답할 때”라며 “이번 국정감사가 인권 정책 전환의 계기가 되길 바란다”고 밝혔다.

On the 30th, Democratic Party of Korea lawmaker Seo Mi-hwa (Health and Welfare Committee) argued during a parliamentary audit that HIV infection should be recognized as a "disability due to impaired immune function."

Human rights groups praised the government's response to the reality of those living with HIV, who have traditionally been excluded from the system.

Representative Seo emphasized, "HIV infection is not a simple disease; it is a complex disability that simultaneously manifests as a weakened immune system and social discrimination." She added, "People living with HIV must be included in laws and systems."

The National Coalition for the Recognition of HIV and Persons with Disabilities expressed its significance, saying, "This inquiry goes beyond expanding welfare and is a meaningful action that questions human dignity and the right to life."

Currently, the Enforcement Decree of the Welfare of Persons with Disabilities Act does not include HIV infection as a type of disability. Consequently, people living with HIV are unable to receive basic support in areas such as employment, transportation, and care.

However, the Korea Institute for Health and Social Affairs (KIHASA) previously defined HIV infection as both a "disability of the immune system" and a "social disability," and in 2022, the UN Committee on the Rights of Persons with Disabilities also recommended that the Korean government include HIV-positive individuals in the category of disability.

The Solidarity Group stated, "The lives of people living with HIV, who are left outside the system simply because they are not on the list, are at a standstill," and added, "The state must no longer hide behind the formalities of the law."

Indeed, a lawsuit seeking the cancellation of the rejection of HIV disability registration is currently underway at the Daegu District Court, drawing attention as a prime example of institutional inconsistencies.

The Solidarity Group used this inquiry as an opportunity to demand that the government: 1) establish criteria for recognizing impairment of immune function as a disability; 2) initiate revisions to the Enforcement Decree of the Act on Welfare of Persons with Disabilities; and 3) pursue legislation to address blind spots in welfare.

The Solidarity Group stated, "If laws are delayed, people will disappear. Now is the time for the state to respond. We hope this parliamentary audit will serve as an opportunity for a shift in human rights policy."
