강대식 의원이 25일 “병적별도관리대상자들의 병역면탈은 병역을 성실히 이행하고 있는 국민들에게 상대적 박탈감을 줄 뿐만 아니라 공정병역의 근간을 해치는 행위”라며  ‘공정병역 3법’을 대표발의했다.

지난해 대형 병역 비리가 적발되면서 병역면탈 혐의자의 상당수가 현행법에 따른 병적 별도관리 대상인 것으로 알려지며 국민적 공분을 산 바 있다.

이 과정에서 병적별도관리대상자들의 병역면탈 방지를 위해 병역면제 또는 병역처분 변경의 원인이 된 질병 등의 치료 기록을 병역이 면제된 후에도 계속 확인할 필요가 있다는 의견이 제기되었다.

이에 강 의원은 질병 치료를 악용한 병역면탈 범죄를 예방하고자 ‘병역법’ 개정안에 공직자 등 병적 별도관리 대상이 전시근로역에 편입되거나 병역이 면제된 때에도 그 질병의 치료 이력을 확인할 필요가 있는 경우 등에는 3년의 범위에서 해당 병적을 계속해 관리할 수 있도록 명시했다.

또한 병역면탈 방지를 위해 병적 별도관리 대상자의 보충역, 전시근로역 또는 병역면제 처분의 원인이 된 질병이나 심신장애의 치료 기록을 병역면제 등의 처분 후에도 계속 확인할 필요성이 있음이 강조됨에 따라 병무청장, 지방병무청장이 의료기관의 장에게 병적 별도관리 대상자의 진료기록 제출을 요청할 수 있도록 해 사후 관리의 실효성을 높이는 ‘의료법’ 개정안을 발의했다.

이와 함께 병무담당 공무원들이 전시 초기 급박한 상황에서 병역자원 소집ㆍ관리 임무를 즉각적으로 대응할 수 있도록 전시임무교육 이수를 의무화하고, 이수하지 아니할 경우 해당 지자체에 제재를 신설하는 등 전시임무교육이 취지에 맞게 이루어지도록 하는 내용을 ‘병역법’ 개정안에 포함시켰다.

강대식 의원은  “병적별도관리대상자들에 대한 보다 면밀한 병역면탈 추적관리가 필요하다”면서 “이번 법률개정안이 병역이행 과정에서의 공정성 회복과 국민에게 신뢰받는 병역문화를 조성하는데 도움이 되길 바란다”고 말했다.
