헌법 제24조에 따르면 장애인도 비장애인과 동등하게 선거 정보 접근권을 갖고 선거일에 투표권을 행사하는 권리가 보장받아야 마땅하다.

한국장애인고용공단 고용개발원에서 조사한 장애인고용패널조사에 따르면, 중증장애인의 투표율은 19대 대선(2017년) 55.9%, 21대 총선(2020년) 63.9%, 20대 대선(2022년) 70.7%로 점차 증가하는 추세를 보이고 있지만, 중앙선거관리위원회에 등록된 각 선거별 전체인구 투표율에 비하면 여전히 저조한 것으로 나타났다.
이에 이번 공직선거법 개정안은 장애 유형별(청각장애인, 시각장애인, 중증장애인)로 장애인의 참정권 보장과 투표 참여 확대를 위해 청각장애선거인의 한국수어 의무화 및 장애인의 투표소 접근 편의를 위한 규정을 명문화하고, 모든 책자형 선거공보물에 그 내용이 수어영상으로 출력되는 인쇄물 접근성 바코드를 표시하도록 하면서 그 비용은 국가 또는 지방자치단체가 부담하도록 했다.
또한 현재 시각 또는 신체의 장애로 기표할 수 없는 선거인에 대한 가족 등의 투표보조를 중증장애인에까지 확대해 본인의 의사에 따라 투표에 적극 참여할 수 있도록 했다.
정희용 의원은 “이번 개정안이 장애인 유권자에 대한 차별과 불편을 조금이나마 해소하고, 실질적인 참정권을 보장함으로써 장애인의 투표 참여 기회를 대폭 확대하는 계기가 될 수 있기를 바란다”며 “앞으로도 장애인 등 사회적 약자들의 불편사항을 발굴해 적극적으로 개선하고, 권익을 보호하는 의정활동에 최선을 다하겠다”라고 밝혔다.
